Host Terms & Conditions

These terms govern your use of Eventixx as an event organiser. By creating an event or selling tickets through our platform, you agree to these terms in full.

These Host Terms & Conditions ("Host Terms") constitute a binding agreement between you ("Organiser", "Host", "you") and Eventixx ("Eventixx", "we", "us"). They apply whenever you create an event, list tickets, or receive payouts through the Eventixx platform. These terms operate alongside our General Terms of Service and Privacy Policy, which you must also accept. Where there is a conflict, these Host Terms take precedence for organiser-specific matters.

1. Introduction

By publishing an event on Eventixx, you confirm that you have read, understood, and agreed to these Host Terms. If you are acting on behalf of a company or organisation, you warrant that you have the authority to bind that entity to these terms.

You are responsible for checking these terms periodically for updates. We will notify you of material changes by email at least 14 days before they take effect. Continued use of the platform after the effective date constitutes acceptance of the revised terms.

2. Event Listings

You may only list genuine events for which you are authorised to sell tickets. By submitting a listing, you warrant that:

  • All event information — including title, date, time, venue, and ticket terms — is accurate and complete.
  • You have obtained (or will obtain before the event date) all required permits, licences, and approvals, including venue agreements, liquor licences, and public safety clearances.
  • The event does not infringe any third-party intellectual property rights, including performers' image rights.
  • You are not listing a fictitious or speculative event to collect funds without a firm intention to deliver.
  • Where the event is suitable only for adults or contains age-restricted content, you have clearly indicated this in the listing and have measures in place to enforce age restrictions at the venue.
  • Ticket quantities listed do not exceed the actual capacity of the venue or the number of tickets you are authorised to sell.

Eventixx reserves the right — at our sole discretion, without liability — to remove, suspend, or decline any listing that we believe:

  • Is not a genuine event.
  • Contains insufficient or misleading information.
  • Violates these terms, our Community Guidelines, or applicable law.
  • Could expose Eventixx or its users to reputational, legal, or financial risk.

You must keep your listing up to date. If event details change materially after tickets have been sold (date, venue, key headliners, or format), you must update the listing immediately and notify affected ticket-holders directly.

3. Our Role

Eventixx acts as a limited payment collection agent on your behalf. When a buyer purchases a ticket, they enter into a contract directly with you, the Organiser — not with Eventixx. Our role is to:

  • Collect ticket sale proceeds from buyers on your behalf via our payment processor (Yoco).
  • Hold those proceeds pending the payout schedule described in Section 5.
  • Deduct our fees as described in Section 4.
  • Issue refunds to buyers where required by these terms, your stated refund policy, or applicable law.
  • Facilitate ticket transfers or upgrades where those features are enabled by you.

A buyer's payment to Eventixx constitutes payment directly to you for the purposes of your obligations to deliver the event. You are obligated to deliver the event and honour all tickets sold, regardless of the timing of your payout from Eventixx.

Eventixx is not the organiser of any event listed on the platform unless explicitly stated. We do not guarantee the quality, safety, legality, or accuracy of any event.

4. What We Charge

Creating an account and listing events on Eventixx is free. Fees are only charged when tickets are sold. Our fee structure is as follows:

Host Platform Fee

5%

Charged on the face value of every paid ticket sold. This fee is always borne by the Organiser and is deducted from your payout — it is never passed to the buyer.

Guest Service Fee

5%

A platform service fee charged per ticket. You choose when creating your event whether this fee is passed to the buyer (added on top of the ticket price) or absorbed by you (deducted from your payout).

Payment Processing Fee

2.9%

Charged by Yoco (our payment processor) on the total amount collected. This fee may be passed to the buyer or absorbed by you, depending on the fee mode you select.

Free Events

Tickets priced at R0.00 incur no platform or processing fees. The Eventixx platform remains free to use for free events.

All fees are calculated on the ticket's face value (excluding any fees already added on top). The exact fee breakdown is always displayed to you in the event creation wizard and in your organiser dashboard.

Our platform fee is non-refundable once a ticket has been sold, even if the buyer receives a refund — except where the event is cancelled by you, in which case Eventixx's fees are also refunded to the buyer.

All amounts are in South African Rand (ZAR). We reserve the right to revise our fee structure with 30 days' written notice to you.

5. Payouts

Eventixx holds ticket sale proceeds on your behalf and pays them out subject to the following conditions:

Standard Payout

Proceeds are paid out within 3 business days after the conclusion of your event, net of all applicable fees.

Payout Requirements

You must have a valid South African bank account linked to your organiser profile and have completed our identity verification process before any payout can be processed.

Your account balance represents a general unsecured claim against Eventixx and does not constitute a trust account. Eventixx may withhold or delay payout where:

  • We reasonably suspect fraudulent transactions or chargebacks are likely.
  • A buyer dispute or refund claim is open and unresolved.
  • You have not completed identity verification or provided required banking details.
  • We are required to do so by applicable law, court order, or regulatory authority.
  • Your account has outstanding amounts owed to Eventixx (including repayment of refunds or chargebacks).

If Eventixx suspects a transaction is fraudulent or a phishing attempt, we may refund the cardholder in full at our discretion. The corresponding amount will be deducted from your payout.

If an amount owing to Eventixx (e.g. from refunds or equipment damage) is not paid within 5 business days of demand, Eventixx may set off that amount against any future payout.

6. Refunds & Cancellations

You are responsible for setting a clear refund policy on your event listing. Your policy must be fair, reasonable, and compliant with applicable law — including the cooling-off period provisions of the Consumer Protection Act 68 of 2008 where applicable.

Eventixx may, at our discretion, process refunds on your behalf where:

  • Your event is cancelled — in which case we will initiate full refunds to all ticket-holders, including our fees.
  • Your event details change materially (date, venue, or headline performers) and a buyer requests a refund on that basis.
  • Your stated refund policy entitles the buyer to a refund and you fail to process it within a reasonable time.
  • We are directed to do so by a consumer tribunal, ombudsman, or court of competent jurisdiction.

Where Eventixx has already paid out proceeds to you, you remain solely responsible for processing all refunds owed to buyers. If Eventixx processes a refund that should have been paid by you, you must reimburse Eventixx within 5 business days.

You are responsible for all chargeback costs, including any chargeback fees levied by Yoco or card networks, where the chargeback arises from your failure to deliver the event or honour your refund obligations.

If you use a payment method not processed through Eventixx, you are solely responsible for ensuring that provider cooperates with any required refund.

7. Curtailed Events

An event is considered "curtailed" if any of the following occurs:

  • The event starts more than 30 minutes later than the advertised start time.
  • A headlining performer or key speaker does not appear, and no equivalent substitute is provided.
  • For virtual events: the stream is delayed or interrupted for more than 30 minutes in total, or the video quality falls below 720p for a sustained period.
  • The event ends more than 30 minutes earlier than the advertised end time without good cause.

In the event of curtailment, Eventixx may, at our discretion:

  • Notify affected ticket-holders by SMS or email (the cost of which will be deducted from your payout).
  • Display a notice on the event listing page.
  • Offer ticket-holders the option of a partial or full refund, to be funded from your payout balance.

You agree to cooperate fully with Eventixx in communicating with ticket-holders in the event of curtailment or cancellation.

8. Promotional Tools

Eventixx may provide promotional and marketing tools including discount codes, referral links, affiliate tracking, and featured placement. Use of these tools is subject to our Privacy Policy and the following rules:

  • You may not use promotional tools for spam, mass unsolicited marketing, or any purpose that violates the Protection of Personal Information Act (POPIA).
  • You may not sell, share, or misuse buyer data obtained through the platform.
  • Referral and affiliate tracking uses cookies stored on buyers' browsers for up to 30 days. You must disclose this in your event marketing where required by law.
  • Promoter commissions, where applicable, are deducted from your payout proceeds and paid to promoters within 3 business days after the event.
  • Eventixx may remove a promoter from your campaign if we determine they are engaging in spamming, cheating, or platform manipulation, in which case their commissions are forfeited.

Any misuse of promotional tools — including fraudulent clicks, fake referrals, or data privacy violations — will result in immediate suspension of your account and may attract legal liability.

9. Data Protection

As an Organiser, you will receive personal information about buyers (names, email addresses, and potentially additional attendee details). You agree to:

  • Handle all buyer data in strict compliance with the Protection of Personal Information Act 4 of 2013 (POPIA) and any other applicable data protection laws.
  • Use buyer data only for the purpose of managing and delivering the event for which the ticket was purchased.
  • Not sell, rent, or share buyer data with any third party without the express consent of the buyer.
  • Implement reasonable technical and organisational security measures to protect buyer data against unauthorised access, loss, or disclosure.
  • Notify Eventixx immediately if you become aware of a data breach affecting buyer data obtained through our platform.
  • Delete buyer personal information within a reasonable time after the event, unless you are required to retain it by law or have obtained consent to retain it for a longer period.

Non-compliance with data protection obligations may result in immediate account suspension, and you will bear full liability for any resulting fines, penalties, or damages.

10. Insurance & Safety

You are solely responsible for the health and safety of all employees, contractors, performers, vendors, ticket-holders, and other attendees at your event. You must:

  • Comply with all applicable health and safety legislation, including the Occupational Health and Safety Act.
  • Ensure the venue is fit for purpose and that crowd management measures are in place for the anticipated attendance.
  • Hold appropriate insurance for your event, including public liability cover with a minimum indemnity limit suitable for your event size. Eventixx may request proof of insurance at any time.
  • Not exceed the venue's licensed or permitted capacity under any circumstances.
  • Have emergency plans, first aid, and evacuation procedures in place for physical events.

Eventixx accepts no responsibility for injury, loss, or damage sustained by any person at your event. Any claims arising from event attendance are your sole liability.

11. Prohibited Conduct

As an Organiser, you agree not to:

  • List a fictitious, speculative, or fraudulent event with no genuine intention to deliver it.
  • Oversell beyond venue capacity or sell tickets you are not authorised to sell.
  • Misrepresent the nature, performers, venue, or terms of the event in any material way.
  • Use the platform to launder money, process fraudulent payments, or circumvent South African financial regulations.
  • Collect funds through Eventixx for events you intend to cancel without valid cause.
  • Sell tickets through Eventixx and simultaneously sell tickets through channels that circumvent our payment agent role, with the intent to avoid payout obligations.
  • Attempt to scrape, reverse-engineer, or exploit the platform's technical systems.
  • Harass, threaten, or abuse Eventixx staff, buyers, or other platform users.
  • Upload content that infringes intellectual property rights or is defamatory, obscene, or unlawful.

Violations may result in immediate account suspension, withholding of all outstanding payouts, cancellation of all active events with full refunds to buyers, and referral to law enforcement or the relevant regulatory authority.

12. Intellectual Property

You retain ownership of all original content you submit to the platform (event descriptions, artwork, photographs). By publishing an event, you grant Eventixx a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purpose of operating and promoting your event and the Eventixx platform.

You warrant that you own or have secured all necessary rights to any content you upload, including performer images, music, and third-party logos, and that publishing the content does not infringe any third-party rights.

Eventixx's name, logo, platform design, and source code are the exclusive property of Eventixx and are protected by South African and international intellectual property law. You may not use our brand assets without prior written permission.

13. Indemnification

You agree to indemnify, defend, and hold harmless Eventixx, its directors, employees, contractors, and agents ("Eventixx Parties") against all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising from:

  • Your event, including any injury, loss, or damage suffered by attendees.
  • Your breach of these Host Terms, the General Terms of Service, or applicable law.
  • Your failure to deliver the event, issue required refunds, or comply with your refund policy.
  • Chargebacks or fraud claims arising from ticket sales for your event.
  • Your infringement of any third-party intellectual property, privacy, or other rights.
  • Any content you submit to the platform that is inaccurate, misleading, or unlawful.

Any reimbursement owed to Eventixx under this clause must be paid within 5 business days of written demand. Failure to pay entitles Eventixx to set off the amount against any current or future payout owed to you.

14. Limitation of Liability

To the fullest extent permitted by South African law, the Eventixx Parties shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform or in connection with your event, including but not limited to:

  • Loss of ticket sale revenue, profits, or business opportunity.
  • Reputational damage resulting from buyer complaints or event reviews.
  • Technical outages, payment processing delays, or QR code failures beyond our reasonable control.
  • Actions or omissions of third-party service providers, including Yoco.

Our total aggregate liability to you for any claim arising from these terms shall not exceed the total platform fees received by Eventixx from ticket sales for the specific event giving rise to the claim.

Force Majeure: Eventixx is not liable for any delay or failure to perform our obligations caused by circumstances beyond our reasonable control, including acts of God, natural disasters, pandemics, riots, war, government actions, power outages, or cyber-attacks.

Nothing in these terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be lawfully excluded under the Consumer Protection Act or POPIA.

15. Termination

Either party may terminate this agreement at any time. You may close your organiser account by contacting us at support@eventixx.co.za. Upon closure, any outstanding payout owed to you will be processed subject to the standard payout conditions in Section 5.

Eventixx may immediately suspend or permanently terminate your organiser account, cancel all active event listings, and withhold pending payouts if we determine that you have:

  • Breached these Host Terms or the General Terms of Service.
  • Engaged in fraudulent conduct or misrepresentation.
  • Failed to deliver an event without valid cause or to process required refunds.
  • Posed an unacceptable risk of harm to buyers or the Eventixx platform.

Where we terminate your account due to your breach, we may process refunds to all affected buyers from your payout balance before remitting any remainder to you.

16. Governing Law

These Host Terms are governed by the laws of the Republic of South Africa. Any dispute arising from or related to these terms shall be subject to the exclusive jurisdiction of the courts of South Africa. The parties agree first to attempt to resolve disputes informally by contacting legal@eventixx.co.za before initiating formal proceedings.

17. Changes to Terms

We may update these Host Terms from time to time. We will notify you of material changes by email to your registered address at least 14 days before the changes take effect. Minor clarifications or changes required by law may take effect immediately.

Continued use of the Eventixx organiser platform after the effective date of any revised terms constitutes your acceptance of those changes.
