Terms of Service

Please read these Terms of Service carefully before using the Eventixx platform operated by Eventixx. By accessing or using our service, you agree to be bound by these terms. If you do not agree, do not use the service.

1. Acceptance of Terms

By creating an account, purchasing a ticket, or listing an event on Eventixx, you confirm that you are at least 18 years of age (or have obtained parental/guardian consent), have read and understood these Terms, and agree to be legally bound by them.

These Terms constitute a binding agreement between you and Eventixx, a company incorporated in the Republic of South Africa. They are governed by the Electronic Communications and Transactions Act 25 of 2002 (ECT Act) and the Consumer Protection Act 68 of 2008 (CPA).

2. Description of Service

Eventixx is an online ticketing and event management platform that enables event organisers ("Organisers") to create and sell tickets, and enables attendees ("Buyers") to discover and purchase tickets to events.

Eventixx acts as an intermediary between Organisers and Buyers. We are not the organiser of any event listed on the platform unless explicitly stated. Eventixx does not guarantee the quality, safety, legality, or accuracy of any event listing.

We reserve the right to modify, suspend, or discontinue any part of the service at any time with reasonable notice.

3. Accounts & Registration

To purchase tickets or list events, you must register for an account. You agree to:

  • Provide accurate, current, and complete information during registration.
  • Maintain the security of your password and accept responsibility for all activity under your account.
  • Notify us immediately at legal@eventixx.co.za if you suspect unauthorised use of your account.
  • Not create more than one personal account without our express permission.

We may suspend or terminate your account if we believe you have provided false information, violated these Terms, or engaged in fraudulent or harmful activity.

4. Ticket Purchases

When you purchase a ticket through Eventixx, you are entering into a contract with the Organiser of that event. Eventixx facilitates this transaction but is not a party to the contract between Buyer and Organiser.

All ticket purchases are subject to the Organiser's own event terms. You are responsible for reviewing the event details — including date, venue, age restrictions, and dress code — before completing a purchase.

Tickets are non-transferable unless explicitly permitted by the Organiser. Reselling tickets above face value ("ticket touting") is prohibited on this platform and may violate South African law.

Eventixx will email a confirmation with your ticket(s) and QR code(s) to the address provided at checkout. You are responsible for ensuring your email address is correct.

5. Fees & Payments

Ticket prices are set by the Organiser. Eventixx charges a platform service fee per ticket sold, which is calculated as:

Platform Fee

5% of ticket price (guest fee component)

Payment Processing Fee

2.9% of ticket price (guest fee component, charged by our payment processor, Yoco)

Host Platform Fee

5% of ticket price (always charged to the Organiser)

Fees may be borne by the Buyer or absorbed by the Organiser, depending on the fee mode selected by the Organiser when creating the event. The final amount payable will always be displayed clearly before you complete your purchase.

All amounts are displayed and charged in South African Rand (ZAR). Payments are processed securely via Yoco. Eventixx does not store your card details.

Free tickets (R0.00) are not subject to platform or processing fees.

6. Refunds & Cancellations

Refund policies are set by the Organiser of each event. Eventixx does not issue refunds on behalf of Organisers unless required to do so by law.

Under the Consumer Protection Act, you may be entitled to a refund if:

  • The event is cancelled by the Organiser.
  • The event details (date, venue, or key headliners) change materially after your purchase.
  • The Organiser has a stated refund policy that covers your circumstances.

If you believe you are entitled to a refund, contact the Organiser directly in the first instance. If you are unable to resolve the matter, contact us at legal@eventixx.co.za and we will assist in mediation.

Eventixx's service fees are non-refundable once a ticket has been issued, except where the event is cancelled by the Organiser.

7. Organiser Responsibilities

If you use Eventixx to create and sell tickets for events, you are also bound by our Host Terms & Conditions, which contain detailed provisions on listings, payouts, refunds, insurance, and data protection. The summary below is not exhaustive.

If you use Eventixx to create and sell tickets for events, you agree to:

  • Provide accurate and complete event information, including date, time, venue, and ticket terms.
  • Honour all tickets sold through the platform and admit ticket-holders to the event.
  • Comply with all applicable South African laws, including licensing, public safety, and noise regulations.
  • Obtain all required permits and licences before selling tickets (e.g., liquor licences, venue approvals).
  • Not misrepresent the nature of the event or use the platform to defraud Buyers.
  • Issue refunds to Buyers as required by law or your stated refund policy.
  • Notify Buyers and Eventixx promptly if an event is cancelled, postponed, or materially changed.

Eventixx reserves the right to withhold payout of ticket sales proceeds if we suspect fraud, a dispute is open, or regulatory requirements demand it.

8. Prohibited Conduct

You agree not to:

  • Use the platform for any unlawful purpose or in violation of these Terms.
  • Sell, transfer, or duplicate tickets obtained through the platform for commercial gain.
  • Create fictitious events or listings to defraud Buyers.
  • Attempt to circumvent our technical measures, including scraping, automated booking, or reverse-engineering.
  • Submit false reviews, reports, or chargebacks without a valid basis.
  • Harass, threaten, or abuse other users of the platform.
  • Upload content that infringes third-party intellectual property rights.
  • Use the platform to transmit spam, malware, or phishing materials.

Violations may result in immediate account termination, cancellation of outstanding tickets or events, and referral to law enforcement where warranted.

9. Intellectual Property

All content on the Eventixx platform — including but not limited to the logo, brand name, interface design, source code, and marketing materials — is the exclusive property of Eventixx and is protected by South African and international intellectual property laws.

By submitting event listings, images, or other content to the platform, you grant Eventixx a non-exclusive, royalty-free, worldwide licence to use, display, and reproduce that content for the purpose of operating and promoting the platform.

You represent that you own or have the right to use all content you submit, and that it does not infringe any third-party rights.

10. Limitation of Liability

To the fullest extent permitted by South African law, Eventixx shall not be liable for:

  • Any indirect, incidental, special, consequential, or punitive damages.
  • Loss of profits, data, goodwill, or business opportunity.
  • Events that are cancelled, postponed, or fail to meet your expectations.
  • Actions or omissions of Organisers or third-party service providers.
  • Technical outages, payment processing delays, or data loss beyond our reasonable control.

Our total liability for any claim arising from the use of the platform shall not exceed the amount you paid for the specific ticket(s) at issue.

Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any liability that cannot be excluded under the Consumer Protection Act.

11. Indemnification

You agree to indemnify, defend, and hold harmless Eventixx, its directors, employees, and agents from any claims, damages, losses, or expenses (including legal fees) arising from your use of the platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

You may close your account at any time by contacting us. Upon termination, your right to use the platform ceases immediately. Any tickets already purchased remain valid unless cancelled pursuant to a refund.

We reserve the right to suspend or permanently ban accounts that violate these Terms, without prior notice, if we determine that immediate action is necessary to protect users or the integrity of the platform.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the South Gauteng High Court, Johannesburg, unless you are a consumer as defined under the CPA, in which case you may elect to resolve a dispute through the National Consumer Commission or applicable consumer court.

14. Changes to Terms

We may update these Terms from time to time to reflect changes in our service, legal requirements, or business practices. We will notify you of material changes by email or prominent notice on the platform at least 14 days before the changes take effect.

Continued use of the platform after the effective date of the revised Terms constitutes your acceptance of those changes.
